Booking Terms
Introduction
The following are general terms and conditions that apply to all rental properties booked using Siam Real Estate (SRE) unless overridden by any property-specific lease terms and conditions.
All bookings are made with Siam Real Estate on the understanding that SRE is acting as an agent introducer on behalf of the owners of properties featured in the company web site or elsewhere. The web site enquiry response form indicates you have read and agreed to the SRE company terms and conditions. The holiday rental booking confirmation becomes a binding agreement when you pay your rental deposit. Sending payment or in the case of a long term rental, paying a deposit constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as printed below.
Long Term Rental
A minimum rental term is 3 months and normally 12 months’ duration or longer.
Rental Contract:
Occupancy is subject to a rental agreement between the owner and tenant which can be obtained from a local lawyer or the company has a standard lease agreement available for 5,000 THB which cost can be shared by owner and tenant.
A lease agreement between the owner and tenant must be agreed and signed prior to occupation by the tenant. The owner may stipulate certain conditions such as no dogs for example. These conditions are strictly between owner and tenant and SVR the company has no involvement; however, these may change from time to time so please check on booking.
Furnishings and facilities:
Most rentals are fully furnished however not all so check on booking as some tenants wish to add their own furniture. Owners do not necessarily provide full living facilities such as cooking utensils, linen etc, so please check with owner on booking.
Deposits:
Rental term 1 year or less - 2 months security deposit and one month rent due in advance.
Rental term 2 years or more – 4 months security deposit and two months rent due in advance.
These terms may vary dependent on the owner.
Deposits are held by the owner not SRE the company and shall be refundable in full provided the property is found to be in the same condition on checking out as check in and all service and utility bills having been paid in full. This is at the discretion of the owner and may take up to 7 days after check out.
N.B. To avoid return bank charges arrange with owner to repay in cash prior to departure.
Payments:
Rent is due on the first of each month in advance and must be paid to the owners account as agreed at the time of booking. Failure to make payment on the due date or within 7 days of the due date is grounds for immediate eviction.
Inventory:
The owner must provide an inventory list and it is up to the tenant to check the property immediately on occupation to agree the content and any discrepancies to be brought to the attention of the owner.
Services:
Such as telephone, internet, UBC TV, gardener, maid, are usually extra unless agreed and included in the lease agreement. These services can be negotiated with the owner.
Maintenance:
Please notify the owner/property manager as soon as possible if a problem relating to the rental property exists. Every effort will be made by the owner to rectify any problem in a timely manner. No refund or rate adjustment will be made for malfunction of air conditioners, TV's, appliances, pool or any other malfunction. Repairs will be made as soon as possible after notification and are the responsibility of the owner.
Restrictions:
Pets, smoking (unless otherwise indicated) hazardous materials or any illegal or immoral activities are strictly prohibited. Evidence of any breach of this term may result in loss of your security deposit and eviction.
Sub let:
The tenant may under no circumstances sub let the premises or allow others to occupy the property during the period of tenancy and the tenancy is for the sole use of the tenant and his partner/ family. The indicated number of guests as shown on the web site booking detail is the maximum allowed. Any abuse by the tenant, the owner has the right to make extra charges at the owner’s discretion.
Premature departure:
The long term rental rate agreed with the owner is for the full term and a tenant departing early will forfeit his deposit and be responsible for paying the outstanding months of the tenancy at the monthly rate agreed to compensate the owner for loss of earnings.
Misuse of the Property:
The owner reserves the right to interrupt service and evict the tenant due to noise complaints, overcrowding or any type of property abuse without a refund. Illegal activities will be cause for immediate eviction by local police.
Prices and Website Accuracy:
Please note, the information and prices shown on our SRE website may have changed by the time you come to book your stay. Whilst every effort is made to ensure the accuracy of the website and prices at the time of requesting the booking, regrettably errors do occasionally occur. You must therefore ensure you check all details of your stay (including the price) on your booking acceptance. Charges are subject to VAT at local rate of 7%.
Holiday Rental
Booking Policy:
- Minimum term: Normally 7-nights however subject to owner’s terms please check listing for minimum nights acceptable.
- 50% deposit upon reservation or pay full amount avoiding extra bank and admin charges.
- 50% 30 days prior to check in (if less than 30 days 100% required)
- Pets, smoking (unless otherwise indicated) hazardous materials or any illegal or immoral activities are strictly prohibited. Evidence of any breach of this term result in loss of your damage deposit and eviction.
- Prior to booking, all prices are subject to change without notice.
- Refunds are not provided due to delayed arrivals.
Cancellation Policy:
- 50% refund of initial deposit if 60 days or more prior to check-in, or 25% of total booking if 100% paid 60 days or more prior to check-in.
- No refund if less than 60 days prior to check-in.
Security Deposit:
The owner usually requires a security deposit of 20,000 THB from the tenant on arrival and is normally refunded within 7 days of departure, provided all extra services have been paid and no damage or loss has occurred and is at the discretion of the owner. Any bank charges incurred on transfer are the responsibility of the booking party. N.B. To avoid return bank charges, arrange with owner to repay in cash prior to departure.
Extras:
The guest will be required to settle all extra charges incurred for services including, but not limited to, utilities, telephones, transportation, personal laundry, or any other service not included in the room rate before departure. Any charges due and not settled will be deducted from the tenants’ deposit.

Payment:
Payment may be made by VISA/MASTER CARD credit card on which there is a 4.5% credit card and admin charge included. You may also pay by Bank transfer and SAVE the credit card charge. The security deposit is to be paid to the owner and credited back to you by the owner less any charges outstanding. N.B. To avoid return bank charges, arrange with owner to repay in cash prior to departure.
Check In:
Check in is 2:00 p.m. unless otherwise arranged with the owner/property manager. You will receive in advance of arrival the check-in package which has been emailed to you upon acceptance of your reservation with owner details, and contact no.s for arrangement of pick up (if offered) keys, directions and services offered by the owner.
Check Out:
Check out is 12:00 a.m. unless otherwise arranged at least 24 hours in advance of departure. Failure to check out by this time may result in a surcharge to your security deposit.
Services:
Maid and other services are as indicated in the web details but are subject to change therefore please check with us if unsure.

Children:
Warning In the interests of safety, parents of young children should be aware that many holiday and long term rental properties due to location, design and open swimming pools require a high degree of supervision, higher than one may be accustomed to elsewhere.
General:
Insurance:
It is a condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).
Siam Real Estate or the owners of the rented properties are held harmless by you and your party against all claims including any accidents or illness related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, car or motorbike rental.
Siam Real Estate shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of our control such as civil disturbances, fires, floods, severe weather, Acts of God, acts of Government etc.
By acceptance of this contract it is assumed by Siam Real Estate that this requirement has and will be complied with in full.
Liability & Disclaimer: Siam Real Estate acts as the introducing agent for each property owner and accepts no liability for disputes, property loss or damages, theft, liability for injury, accidents, delay, or any irregularity while staying in any rented property. Furthermore, guests are responsible for their villa or apartment during occupancy, and must lock windows and doors securely at all times when not on the premises. You must also observe all precautions given by the owner or our staff. Tenants are required to insure their personal possessions prior to occupation. The owner reserves the right to withhold part or all of security deposit to pay for unpaid bills or damage caused to the property while in occupation.
Applicable law: These conditions and any contract to which they apply are governed in all respects by Thailand law and Thailand courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
